Did you know that according to the Migratory Bird Treaty Act (MBTA), “it is unlawful to pursue, hunt, take, capture, kill, possess, sell, or transport any protected bird, or any part, nest, or egg, without a federal permit.” This law protects the vast majority of native birds in the U.S., including hawks, eagles, herons, owls, and songbirds. The law does not protect introduced species of birds, such as house sparrows and pigeons.
Because of this law, we observe extreme caution around suspected active bird’s nests, and do not perform jobs that require us to remove/disturb an active nest during nesting season. In the Northern Virginia area, nesting season starts on April 1st and ends on August 31st.
What Should I Do If I Encounter An Active Bird’s Nest?
Leave it. Remember, it is likely illegal to disturb the nest. Allow for the nesting process to occur; this process usually takes about 4–6 weeks. Once the chicks have fledged (left) from the nest, carefully remove the nest using proper safety/sanitary equipment, or you can call us and we can take care of that for you. After this process is complete, we can go ahead and complete any work, such as soffit or gutter repair in or around your home that may have been delayed due to the active nest.
